Atlas Intel Terms of Service
Effective date: October 29, 2026
These Terms of Service (the "Terms") are an agreement between Atlas Sales AI LLC, a Tennessee limited liability company ("Atlas," "we," "us"), and the business that creates an Atlas Intel account or signs an order for it ("Customer," "you"). The person accepting these Terms confirms they have authority to bind Customer.
These Terms cover the Atlas Intel software. Use of the atlassales.io website alone is covered by the website terms at atlassales.io/terms.
The following documents are part of these Terms: the Data Processing Addendum, the Call Recording and Consent Addendum, the Acceptable Use Policy, and the Service Level Objectives. If they conflict, this order controls: (1) a signed order form, if any; (2) the Data Processing Addendum, for personal information; (3) the Call Recording and Consent Addendum; (4) these Terms; (5) the Acceptable Use Policy; (6) the Service Level Objectives.
Our Data Commitments
These commitments are binding parts of these Terms and the Data Processing Addendum:
- You own your data. Customer Data and Output belong to Customer.
- We never sell your data. Atlas does not sell, rent, license, share for advertising, or otherwise monetize Customer Data, in identifiable, aggregated, or de-identified form.
- Only de-identified data improves the product. Atlas may use De-identified Data, with every name, contact detail, and identifying detail removed, to improve Atlas Intel's scoring and coaching. It never identifies Customer or any person, is never sold or shared, and is never used for advertising. Atlas opts out of vendor model training wherever its AI and transcription vendors offer it.
- Your data stays yours alone. Each customer's identifiable data is isolated at the database level and is never shown to, combined with, or used to serve another customer.
- Encrypted and access-controlled. Customer Data is encrypted in transit and at rest, and connected-system credentials are separately encrypted.
- You hear from us fast. Atlas will notify Customer within 72 hours of confirming a Security Incident affecting its data.
- You can leave with your data. Customer can export its data for 30 days after cancellation, and Atlas then deletes it within 90 days.
1. Definitions
- "Service" means the Atlas Intel software, dashboards, scorecards, reports, and related support that Atlas provides.
- "User" means an individual Customer authorizes to use the Service, such as an owner, director, manager, sales rep, or setter.
- "Connected Rep" means a User with a rep or setter seat on Customer's account who has a call-recording source connected on the date Atlas counts seats for billing. A seat with no connected recording source is not a Connected Rep.
- "Connected Source" means a third-party system Customer connects to the Service, such as a call recorder, meeting platform, CRM, or payment processor.
- "Customer Data" means all data Customer or its Users submit to the Service or that the Service pulls from a Connected Source on Customer's behalf, including call recordings, transcripts, CRM records, appointment data, sales scripts, and payment-processor records.
- "De-identified Data" means data derived from Customer Data from which Atlas has removed names, contact details, company names, account and payment numbers, addresses, and any other information that identifies, or could reasonably be linked to, Customer, its Users, or any individual on a call.
- "Output" means scores, scorecards, summaries, coaching notes, metrics, and reports the Service generates from Customer Data.
2. The Service
2.1 Access. Subject to these Terms and payment of fees, Atlas grants Customer a non-exclusive, non-transferable right during the subscription term for its Users to access and use the Service for Customer's internal business purposes.
2.2 Users. Customer controls who gets a seat and what each seat can see. Customer is responsible for its Users' acts and for keeping login credentials confidential. Customer will tell Atlas promptly if it learns of unauthorized access.
2.3 Connected Sources. Customer authorizes Atlas to access each Connected Source Customer connects, using the credentials or keys Customer provides, solely to provide the Service. Connected Sources are third-party products governed by their own terms. Atlas is not responsible for their availability, accuracy, data retention, or changes to their interfaces. Customer can disconnect a source at any time.
2.4 Changes. Atlas may improve or change the Service. Atlas will not make a change that materially reduces the core functionality of the Service during a paid term without notice.
2.5 Support. Atlas provides support as described in the Service Level Objectives.
3. Free Trial
3.1 Trial period. New customers may receive a free trial of 60 days starting on the day the account is created (the "Trial"). Atlas may offer one Trial per business.
3.2 Card on file. A valid payment card is required to start the Trial. Nothing is charged during the Trial.
3.3 Automatic conversion. Unless Customer cancels before the Trial ends, the subscription converts to a paid monthly subscription and the card on file is charged the fees in Section 4 on day 61, and then every month until Customer cancels. By starting the Trial, Customer authorizes these recurring charges.
3.4 Cancelling during the Trial. Customer can cancel at any time during the Trial as described in Section 5.2 and will not be charged.
4. Fees and Payment
4.1 Subscription fees. After the Trial, the subscription costs $495 per month, which includes up to 3 Connected Reps. Each additional Connected Rep costs $79 per month.
4.2 How reps are counted. Atlas counts Connected Reps on each monthly billing date. The base fee is charged on each billing date. Any additional Connected Reps counted on that date are charged as a separate charge to the same card on or about the same date. Setters count as reps.
4.3 Billing processor. Payments are processed by Atlas's third-party payment processor. Atlas does not store full card numbers.
4.4 Taxes. Fees do not include taxes. Customer pays any sales, use, or similar taxes that apply, other than taxes on Atlas's income.
4.5 Failed payments. If a charge fails, Atlas may retry it and may suspend the Service after giving Customer at least 7 days' notice to update payment details.
4.6 Price changes. Atlas may change prices with at least 30 days' notice by email. The new price applies from the next billing date after the notice period. Customer may cancel before then.
4.7 No refunds. Fees are charged monthly in advance. Except where the law requires otherwise, fees are not refunded once a charge has run, including for partial months or unused seats.
5. Term, Cancellation, and Termination
5.1 Term. The subscription runs month to month from the end of the Trial until cancelled.
5.2 How to cancel. Customer can cancel at any time by (a) cancelling the membership in the billing portal linked from Customer's receipt or account, or (b) emailing legal@atlassales.io from an account owner's email address. Cancellation stops all future charges. Paid access continues until the end of the month already paid for.
5.3 Termination for breach. Either party may terminate these Terms if the other materially breaches them and does not cure the breach within 30 days after written notice.
5.4 Suspension. Atlas may suspend access immediately, in whole or in part, if needed to (a) prevent harm to the Service, other customers, or any person; (b) respond to a violation of the Acceptable Use Policy or the Call Recording and Consent Addendum; or (c) comply with law. Atlas will notify Customer and restore access once the issue is resolved.
5.5 Effect of termination. When the subscription ends, Users lose access. For 30 days afterward, Customer may request an export of its Customer Data in a standard format. Atlas then deletes Customer Data as described in the Data Processing Addendum.
6. Customer Responsibilities
6.1 Lawful use. Customer will use the Service in compliance with all laws that apply to it, including laws on call recording, privacy, telemarketing, consumer protection, and employment.
6.2 Recording consent. Customer is solely responsible for obtaining every notice and consent the law requires to record, transcribe, and analyze its calls, as set out in the Call Recording and Consent Addendum.
6.3 Rights to Customer Data. Customer represents that it has all rights and permissions needed to provide Customer Data to Atlas and to let Atlas process it as these Terms describe.
6.4 Payment card information. Customer will not use the Service to collect, store, or process payment card data. Customer will instruct its Users not to read card numbers, expiration dates, or security codes aloud on recorded calls. Atlas automatically redacts payment card numbers it detects in transcripts and text it stores, but this is a safeguard, not a guarantee, and the Service is not a PCI DSS cardholder data environment. Original recordings held in a Connected Source are outside Atlas's control.
6.5 Acceptable use. Customer will follow the Acceptable Use Policy.
7. Automated Scoring and Output
7.1 What Output is. The Service uses automated tools, including third-party artificial intelligence services, to transcribe calls and to score them against the sales script Customer uploads. Output is an automated assessment meant to help coaching and sales management.
7.2 No guarantee of accuracy. Output may contain errors, including transcription errors, speaker mix-ups, and scores that a human reviewer would grade differently. Customer should review Output before relying on it.
7.3 Employment decisions. The Service is not designed to be the sole basis for any decision to hire, fire, discipline, promote, or set the pay of any person. Customer will keep meaningful human review of any such decision, and Customer alone is responsible for those decisions and for complying with employment and anti-discrimination laws, including any laws on automated decision systems.
7.4 No guarantee of results. Atlas does not promise any level of sales, revenue, close rate, or other business result.
8. Customer Data and Privacy
8.1 Ownership. Customer owns Customer Data and Output generated from it.
8.2 Atlas's use. Atlas uses Customer Data only to provide, secure, support, and maintain the Service for Customer, and as described in the Data Processing Addendum.
8.3 Product improvement with De-identified Data. Customer authorizes Atlas to create De-identified Data from Customer Data and to use it, alone or combined with De-identified Data from other customers, only to develop, train, test, and improve the Service, including its scoring and coaching models. Atlas will (a) take reasonable technical and organizational measures so De-identified Data cannot be linked to Customer, its Users, or any individual; (b) publicly commit, and hereby commits, not to re-identify it or attempt to; (c) never sell, license, or disclose it to third parties, other than Subprocessors bound to the same restrictions, and never use it for advertising; and (d) never use identifiable Customer Data for training. Atlas uses third-party AI and transcription providers under commercial terms that limit their use of Customer Data, and opts out of their model training wherever offered. Those providers' use of data is governed by their own terms, which Atlas will identify on request. De-identified Data is not Customer Data and may be kept after the subscription ends.
8.4 Isolation. Each customer's identifiable data is kept logically separate. Atlas does not combine, match, or share identifiable data across customer accounts.
8.5 Service metrics. Atlas may collect technical information about how the Service runs, such as uptime, error rates, and processing counts, to operate and improve the Service. This information does not identify Customer, its Users, or any individual on a call.
8.6 Privacy. The Data Processing Addendum governs Atlas's processing of personal information in Customer Data. The Atlas Privacy Policy describes how Atlas handles information about Customer's account contacts.
9. Confidentiality
Each party will protect the other's non-public business, technical, and financial information that it receives under these Terms ("Confidential Information") with at least reasonable care, use it only to perform under these Terms, and disclose it only to employees, contractors, and advisers who need to know it and are bound by similar obligations. This does not apply to information that is public through no fault of the recipient, already known to it, independently developed, or rightfully received from a third party. A party may disclose Confidential Information when the law requires, after giving notice where legally allowed. Customer Data is Customer's Confidential Information.
10. Intellectual Property
10.1 Atlas's rights. Atlas and its licensors own the Service, including its software, scoring methods, designs, and documentation, and all improvements to them. No rights are granted except as stated in these Terms.
10.2 Restrictions. Customer will not (a) copy, modify, or create derivative works of the Service; (b) reverse engineer or try to extract its source code, scoring methods, or prompts, except as the law expressly permits; (c) resell, sublicense, or provide the Service to third parties; (d) access the Service to build a competing product; or (e) bypass any security or usage limits.
10.3 Feedback. If Customer gives suggestions about the Service, Atlas may use them without obligation.
11. Security
Atlas maintains the administrative, technical, and physical safeguards described in the Data Processing Addendum. Atlas will notify Customer of a Security Incident affecting Customer Data as the Data Processing Addendum provides.
12. Warranties and Disclaimers
12.1 Mutual. Each party represents that it has the authority to enter into these Terms.
12.2 Atlas. Atlas warrants that it will provide the Service in a professional manner consistent with general industry standards. Customer's remedy for breach of this warranty is for Atlas to correct the problem or, if Atlas cannot, for Customer to cancel and receive a refund of fees prepaid for the period after cancellation.
12.3 Disclaimer. EXCEPT AS STATED IN THIS SECTION 12, THE SERVICE AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." ATLAS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ATLAS DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED OR THAT OUTPUT WILL BE ACCURATE OR COMPLETE.
13. Indemnification
13.1 By Customer. Customer will defend and indemnify Atlas and its members, officers, and contractors against third-party claims, and resulting losses, fines, and reasonable attorneys' fees, arising from (a) Customer's failure to obtain any notice or consent required to record, transcribe, or analyze a call; (b) Customer Data, or Customer's right to provide it; (c) Customer's employment or other decisions made using Output; or (d) Customer's violation of law or the Acceptable Use Policy.
13.2 By Atlas. Atlas will defend and indemnify Customer against third-party claims that the Service, as provided by Atlas, infringes a United States patent, copyright, or trademark, or misappropriates a trade secret. This does not apply to claims caused by Customer Data, Connected Sources, or use of the Service in breach of these Terms. If the Service is or may be found infringing, Atlas may modify it, obtain a license, or end the subscription and refund prepaid fees for the remaining period.
13.3 Process. The indemnified party must give prompt notice of the claim, let the indemnifying party control the defense and settlement, and reasonably cooperate. No settlement may impose an obligation on the indemnified party without its consent.
14. Limitation of Liability
14.1 Exclusion. NEITHER PARTY IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THEIR POSSIBILITY.
14.2 Cap. EACH PARTY'S TOTAL LIABILITY ARISING OUT OF THESE TERMS WILL NOT EXCEED THE FEES CUSTOMER PAID ATLAS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
14.3 Exceptions. Sections 14.1 and 14.2 do not limit (a) Customer's payment obligations; (b) either party's indemnification obligations; (c) Customer's liability under Section 6 or the Call Recording and Consent Addendum; or (d) liability for fraud, gross negligence, or willful misconduct.
15. Disputes
15.1 Governing law. These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules.
15.2 Informal resolution. Before starting arbitration, a party must send written notice of the dispute and the parties will try in good faith to resolve it for 30 days.
15.3 Arbitration. Any unresolved dispute arising out of these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before one arbitrator, in Knox County, Tennessee, or by video conference if the parties agree. Judgment on the award may be entered in any court with jurisdiction.
15.4 Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect its intellectual property or Confidential Information. Atlas may sue in court to collect unpaid fees.
15.5 No class actions. Disputes will be resolved only on an individual basis, not as a class, consolidated, or representative action.
16. General
16.1 Notices. Atlas will send notices to the account owner's email address. Customer sends notices to legal@atlassales.io, with a copy by mail to Atlas Sales AI LLC, 116 Agnes Rd, Ste 200, Knoxville, TN 37919.
16.2 Changes to these Terms. Atlas may update these Terms by posting a new version and emailing account owners at least 30 days before it takes effect. If Customer does not agree, it may cancel before the effective date. Continued use after that date means Customer accepts the update.
16.3 Assignment. Neither party may assign these Terms without the other's consent, except to a successor in a merger, acquisition, or sale of substantially all of its relevant assets, with notice.
16.4 Publicity. Atlas will not use Customer's name or logo in marketing without Customer's written permission.
16.5 Force majeure. Neither party is liable for delays caused by events beyond its reasonable control, other than payment obligations.
16.6 Independent parties. The parties are independent contractors. These Terms create no partnership, agency, or employment relationship.
16.7 Survival. Sections 4 (for unpaid fees), 5.5, 7, 8, 9, 10, 12.3, 13, 14, 15, and 16 survive termination.
16.8 Entire agreement. These Terms, with the documents listed at the top, are the entire agreement on their subject and replace any prior understanding. If any provision is unenforceable, the rest stays in effect. A waiver must be in writing. Electronic acceptance is binding.
