Atlas Intel Call Recording and Consent Addendum
Effective date: October 29, 2026
This Addendum is part of the Atlas Intel Terms of Service (the "Terms") between Atlas Sales AI LLC ("Atlas") and Customer. It explains who is responsible for consent when Customer's calls are recorded and analyzed. Capitalized terms not defined here have the meaning in the Terms.
1. How Atlas Intel Works With Recordings
1.1 Atlas does not place, receive, or record calls. Customer records its own calls with a call recorder or meeting platform that Customer chooses and connects (a Connected Source). Atlas then retrieves the recording, transcript, or a link to them from that Connected Source, transcribes it if needed, and uses automated tools, including artificial intelligence, to score it against Customer's sales script.
1.2 Because Customer decides which calls are recorded and connected, Customer is responsible for every notice and consent the law requires for the recording, transcription, and automated analysis of those calls.
2. All-Party Consent on Every Call
2.1 Many states require the consent of everyone on a call before it can be recorded. As of the date of this Addendum they include California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, and Washington. Rules differ for phone calls, video calls, cell phones, and in-person conversations, and they change.
2.2 Because a caller's location is often unknown, Customer will obtain the consent of every participant on every recorded call, regardless of where Customer or the participants are located.
2.3 Consent must be obtained at the start of the call, before substantive conversation begins, and must cover recording, transcription, and analysis by automated tools.
3. Required Disclosure
3.1 At the start of each recorded call, the Customer's rep or system will clearly say a disclosure at least as informative as this:
"Just so you know, this call is recorded, and we use software to transcribe and review it for quality and training. Is that okay with you?"
3.2 If a participant does not agree, the rep will stop recording, or end the call and offer to continue without recording. A call recorded without consent must not be connected to Atlas Intel, and if it already has been, Customer will delete it as described in Section 7.
3.3 For video meetings, Customer will also make sure the meeting platform or note-taking tool shows its standard on-screen recording notice, and will include a recording notice in calendar invitations where practical.
3.4 Automated beeps or a recorded announcement may be used in addition to, but not instead of, the disclosure in Section 3.1, unless Customer's counsel advises that a different method satisfies the law where Customer operates.
4. Notice to Customer's Own Team
4.1 Before connecting a User's calls, Customer will tell its reps, setters, and other Users in writing that their calls will be recorded, transcribed, and scored by automated tools, what is collected, and how the scores are used.
4.2 Where Customer's Users are California residents or are located in other states with employee privacy rights, Customer will give any notice at collection those laws require.
4.3 Customer will keep meaningful human review of any employment decision informed by Atlas Intel scores, as required by Section 7.3 of the Terms.
5. Calls and Messages to Prospects
5.1 Atlas Intel does not dial phone numbers, send text messages, or send marketing emails to Customer's prospects or customers.
5.2 Customer is solely responsible for compliance with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, CAN-SPAM, state telemarketing and "mini-TCPA" laws, and do-not-call rules for its own outreach, including outreach that leads to calls later reviewed in Atlas Intel.
6. Sensitive Information on Calls
6.1 Payment cards. Customer will instruct its Users not to take payment card numbers, expiration dates, or security codes on recorded calls. Payments should be taken by a secure payment link, or the recording should be paused while card details are given. Atlas redacts card numbers it detects in transcripts, but original recordings stay in Customer's Connected Source, and Customer is responsible for deleting any that contain card data.
6.2 Other sensitive information. Customer will take reasonable steps to keep Users from collecting health information, Social Security numbers, bank account numbers, and similar sensitive data on recorded calls unless needed for the sale and permitted by law.
7. Deletion Requests
7.1 If a call participant asks Customer to delete their recording, or if a call was recorded without valid consent, Customer may delete the call in Atlas Intel or ask Atlas to delete it by emailing legal@atlassales.io with the call date and rep name.
7.2 Atlas will delete the call, its transcript, and its scores from active systems within 10 business days of a valid request. Customer is responsible for deleting the original from its Connected Source.
8. Records
Customer will keep reasonable records of its consent practices, such as its disclosure script and rep training, and will provide them to Atlas on request if a complaint or claim about a call is made.
9. Responsibility
9.1 Atlas does not give legal advice, and the disclosure in Section 3.1 is a minimum, not a guarantee of compliance. Customer should confirm its practices with its own counsel.
9.2 Customer's indemnification of Atlas under Section 13.1 of the Terms covers claims arising from Customer's failure to meet this Addendum. Atlas may suspend processing of calls from a Connected Source if it reasonably believes calls are being recorded without required consent.
